The article discusses a court case wherein the 6th Circuit Court of Appeals ruled that dictating the venue in a plan document is not in conflict with the provisions of the Employment Retirement Income Security Act (ERISA). In the case Smith v. Aegon Companies Pension Plan, a lawsuit was filed by plaintiff Roger L. Smith in the U.S. District Court for the Western District of Kentucky that was dismissed by the court under Rule 12 (b) (6) due to the venue selection clause in the retirement plan.
