The article argues in favor of the Living Constitution approach towards the Constitution in the U.S. In the past 35 years, the evolving Constitution has imposed a vast array of new restrictions upon administrative, judicial, and legislative action. And the future agenda of constitutional evolutionists is the same--the creation of new restrictions upon democratic government, rather than the eliminating the old ones. The most obvious refutation is the modern Court's limitation of the constitutional protections afforded to property.
