JURIDISCTIONAL IMMUNITY OF STATES. (English)

This article analyzes the development of doctrine of state immunity and discusses the main challenges faced by foreign countries and Lithuanian judicial practice while applying the state immunity. In this article, also an issue of regulation's absence of restricted state immunity is being raised, what leads to the problem to set the criteria both when state could invoke this immunity and how exactly the refusal from immunity should be expressed. Straipsnyje analizuojama valstybės imuniteto doktrininė raida ir nurodomos pagrindinės valstybės imuniteto taikymo problemos, su kuriomis susiduria užsienio valstybių teismai, ir aptariama negausi Lietuvos teismų praktika. Taip pat straipsnyje keliamas riboto valstybės imuniteto reglamentavimo nebuvimo klausimas, o tai sukelia problemų nustatant kriterijus, kada valstybė gali naudotis imunitetu ir kaip turėtų būti išreiškiamas valstybės atsisakymas imuniteto.
