      The article discusses the right of first publication which was affected by the U.S. Copyright Act of 1976. Information is provided on how first publication is required by U.S. copyright law in order to secure federal statutory copyright protections for creative works. The author argues that the right of first publication should extend to online creative content in order to dispose of the fair use defense often used in the prosecution of copyrighted works online.
