ZAŠTITA NA RADU NA PRIVREMENIM I POKRETNIM GRADILIŠTIMA.

SAFETY AT WORK ON TEMPORARY AND MOBILE CONSTRUCTION SITES.

Safety at work is an integral part of organisation, work process and production. Each segment in the process needs to be governed by safety considerations and provide work conditions that prevent injury at work, occupational diseases and other work-related diseases. This applies also to the 'minimum safety and health conditions on temporary and mobile construction sites' set out in the Regulations on Safety at Work on Temporary or Mobile Construction Sites (N.N. no. 51/08) issued by the Minister of Economy, Labour, and Entrepreneurship, with authority to do so set out in Article 12 par. 1 of the Occupational Safety Act. The paper analyses the provisions of the aforementioned Regulations from two points of view: primarily from the point of view of safety at work and with reference to the construction regulations and other 'special regulations'. Provided in the paper are the terms, work plan, site registration, coordinator nomination, necessity to comply with the principles of safety at work in the project design stage and in the actual operational stage (obligations of the investor and contractor), obligations of contractors and other persons on the site, information, counselling and participation of workers, and the content of Annexes I-V of the Regulations. Zaštita na radu je sastavni dio organizacije i procesa rada i proizvodnje (u najširem smislu riječi). Svaki segment tog procesa treba (i mora) sadržavati sigurnost i uvjete rada kako bi se spriječilo nastajanje ozljeda na radu, profesionalnih bolesti i drugih bolesti u vezi s radom. To se odnosi i na „minimalne sigurnosne i zdravstvene uvjete za privremena i pokretna gradilišta‟, što se uređuje Pravilnikom o zaštiti na radu na privremenim ili pokretnim gradilištima (N.N., br. 51/08.) kojega je donio ministar gospodarstva, rada i poduzetništva, pozivom na ovlasti iz odredbi članka 12., st. 1. Zakona o zaštiti na radu. U ovom članku analiziraju se odredbe navedenog Pravilnika sa dva aspekta: primarno, s aspekta zaštite na radu i drugo, prema propisima o građenju i drugim „posebnim propisima‟. Navode se pojmovi, plan izvođenja radova, prijava gradilišta, imenovanje koordinatora, poštovanje načela zaštite na radu u fazi izrade projekta i u fazi izvođenja radova (obveza investitora i izvođača); obveze izvođača i drugih osoba na gradilištu, obavještavanja, savjetovanja i sudjelovanja radnika, te sadržaj „Dodataka‟ I do V Pravilnika. Pravilnik je stupio na snagu 13.5.2008., a primjenjuje se u roku od godine dana od dana njegovoga stupanja na snagu. [ABSTRACT FROM AUTHOR]
