ZASADA PAŃSTWA PRAWNEGO JAKO ARGUMENT PRZETARGOWY W DYSKURSIE POLITYCZNYM NA TEMAT LUSTRACJI. (Polish)

The Principle of the Rule of Law as an Argument in the Political Discourse on Vetting. (English)

Since the notion of Polish constitutional principle of the rule of law (zasada „państwa prawnego") is quite vague and too general, it is often used in a manipulative way in the political discourse on vetting. Analysis of political discourse in the articles from Polish daily national newspapers Gazeta Wyborcza i Rzeczpospolita (January -- June 2005) shows how representatives of the symbolic elites of Polish society use arguments based on the Polish constitutional principle in order to demonstrate the need for vetting or lack of it. The Polish concept of the rule of law bears a different meaning depending on the context. The paper illustrates how institutional positions of the elite representatives as well as their language competency -- as Pierre Bourdieu remarked -- influence their persuasive power. Konstytucyjna zasada „państwa prawnego" jest pojęciem nieostrym i ogólnikowym, co sprzyja instrumentalnemu jej użyciu w dyskursie politycznym dotyczącym lustracji, a nawet manipulacji tym pojęciem. Analiza artykułów z „Gazety Wyborczej" i „Rzeczpospolitej" (styczeń -- czerwiec 2005) ukazuje, jak przedstawiciele polskich elit symbolicznych posługują się tą zasadą dla uzasadnienia, lub nie, lustracji. Koncepcja „państwa prawnego" nabiera różnych treści w zależności od kontekstu, w którym jest cytowana. Instytucjonalne pozycje przedstawicieli elit symbolicznych oraz ich kompetencja językowa -- zgodnie ze spostrzeżeniami Pierre'a Bourdieu -- wzmacniają moc argumentów podnoszonych w dyskusji.
