- Abstract:
The article reports on the initiative of the U.S. Environmental Protection Agency in requiring all companies to have a hazardous material plan in case of spill emergencies. The government stated that liability is an important incentive mechanism, one that is seeing increasing use in environmental policy. The agency has developed Section 3008 of the Resource and Recovery Act which allows for civil penalties up to $35,500 per day and could also include criminal penalties and additional fines for each violation.
