The article presents information on U.S. Supreme Court case Town of Castle Rock, Colorado v. Gonzales, case number 04-278, argued on March 21, 2005 and decided on June 27, 2005. Respondent Jessica Gonzales alleges that the Due Process Clause of the Fourteenth Amendment to the U.S. Constitution was violated by the town when its police officers failed to respond to her repeated reports that her estranged husband was violating the terms of a restraining order. The rejection of a substantive due process claim was affirmed by a panel of the Court of Appeals, but found that Gonzales had alleged a procedural due process claim. The same disposition was reached by a divided court, concluding that Gonzales had a protected property interest in the enforcement of the terms of her restraining order and that the town had deprived her of due process.
