- Abstract:
The article presents information on U.S. Supreme Court case Pacificare Health Systems, Inc., et al. v. Book et al., case number 02-215, argued on February 24, 2003 and decided on April 7, 2003. A group of physicians filed a suit against managed health care organizations for alleged violation of the Racketeer Influenced and Corrupt Organizations Act by failing to reimburse the physicians for health care services that they had provided to patients covered by the organizations' plans. The request of petitioners to compel arbitration was denied by the District Court. According to the opinion of the court delivered by Justice Antonin Scalia, the proper course is to compel arbitration.
