The article presents the concurring opinion of U.S. Supreme Court Chief Justice William Rehnquist on the case Connecticut Department of Public Safety (DPS) et al v. Doe, case number 01-1231, argued on November 13, 2002 and decided on March 5, 2003. The respondent, a convicted sex offender, alleges that the Megan's Law violates the 14th Amendment's Due Process Clause. Megan's law requires convicted sexual offenders to register with DPS upon community release. The Court of Appeals for the Second Circuit affirmed the claims of the respondent that the law deprives a liberty interest among sex offenders. But the Supreme Court reversed the Second Circuit's judgment saying that due process doe not require the opportunity to prove a fact that is not material to a statutory scheme.
