      The article presents information on U.S. Supreme Court case Ashcroft, Attorney General, et. al. v. Free Speech Coalition et. al., case number 00-795, argued on October 30, 2001 and decided on April 16, 2002. The case considers whether the Child Pornography Prevention of Act 1996 abridges the freedom of speech. Justice Anthony Kennedy delivered the opinion of the Court, which upheld the ruling of the U.S. Court of Appeals for the Ninth Circuit. The Circuit held that the Act's provisions expanding the federal prohibition on child pornography to include not only pornographic images made using actual children, are unconstitutional. These provisions are inconsistent with the nature of obscenity under Miller v. California or produced by exploitation of real children as in New York v. Ferber.
