      This study discusses the application of *Economic Analysis of Law* in the coal mining business licensing policy in Indonesia, as well as an analysis of the existing regulatory and incentive systems. The purpose of this study is to identify potential improvements in efficiency and sustainability in natural resource management, especially in the coal mining sector. Using an economic analysis approach, this study examines the social, economic, and environmental impacts of the existing licensing policy, and assesses the effectiveness of incentives provided to encourage more sustainable mining practices. The results of the study indicate that the application of *Economic Analysis of Law* can serve as an effective instrument to improve the efficiency of the licensing system, taking into account the environmental and social impacts generated by mining activities. However, the main challenge faced is how to balance short-term economic interests with the sustainability of natural resources and the quality of life of the community. The existing regulatory and incentive systems still face a number of problems, such as complicated bureaucracy, weak supervision, and the potential for *regulatory capture*, which reduces investment attractiveness and can harm the community and the environment. This study recommends that the regulation and incentive system in the coal mining business licensing policy in Indonesia be simplified, strengthened with strict supervision, and take into account social and environmental externalities. With these steps, it is hoped that the coal mining sector can provide maximum economic benefits without sacrificing environmental sustainability and social welfare. [ABSTRACT FROM AUTHOR]

      Penelitian ini membahas penerapan Economic Analysis of Law dalam kebijakan perizinan usaha pertambangan batu bara di Indonesia, serta analisis terhadap sistem regulasi dan insentif yang ada. Tujuan dari penelitian ini adalah untuk mengidentifikasi potensi peningkatan efisiensi dan keberlanjutan dalam pengelolaan sumber daya alam, khususnya dalam sektor pertambangan batu bara. Dengan menggunakan pendekatan analisis ekonomi, penelitian ini mengkaji dampak sosial, ekonomi, dan lingkungan dari kebijakan perizinan yang ada, serta menilai efektivitas insentif yang diberikan untuk mendorong praktik pertambangan yang lebih berkelanjutan. Hasil penelitian menunjukkan bahwa penerapan Economic Analysis of Law dapat berfungsi sebagai instrumen yang efektif untuk meningkatkan efisiensi sistem perizinan, dengan mempertimbangkan dampak lingkungan dan sosial yang dihasilkan oleh kegiatan pertambangan. Namun, tantangan utama yang dihadapi adalah bagaimana menyeimbangkan kepentingan ekonomi jangka pendek dengan keberlanjutan sumber daya alam dan kualitas hidup masyarakat. Sistem regulasi dan insentif yang ada masih menghadapi sejumlah masalah, seperti birokrasi yang rumit, lemahnya pengawasan, dan potensi regulatory capture, yang mengurangi daya tarik investasi dan dapat merugikan masyarakat dan lingkungan. Penelitian ini menyarankan agar regulasi dan sistem insentif dalam kebijakan perizinan usaha pertambangan batu bara di Indonesia disederhanakan, diperkuat dengan pengawasan yang ketat, dan lebih memperhitungkan eksternalitas sosial dan lingkungan. Dengan langkah-langkah ini, diharapkan sektor pertambangan batu bara dapat memberikan manfaat ekonomi yang maksimal tanpa mengorbankan keberlanjutan lingkungan dan kesejahteraan sosial.
