- Abstract:
In the following article, one of a practical nature, an analysis of a court decision, pronounced on appeal, is made. The employee was disciplined with a 10% salary reduction for 3 months, on the grounds that he committed a disciplinary offense consisting of transporting two 5-liter containers full of diesel fuel in the cab of the bus he was driving. He thus endangered the safety of passengers and the vehicle entrusted to him. The court of first instance admitted the employee's appeal, and the higher court admitted the employer's appeal, and rejudging the case on the merits, rejected the employee's appeal. În articolul care urmează, unul cu caracter practic, se face o analiză a unei hotărâri judecătorești, pronunțate în apel. Salariatul a fost sancționat disciplinar cu reducerea salariului cu 10% pe 3 luni, pe motivul că a comis o abatere disciplinară constând în transportarea în cabina autobuzului pe care îl conducea a două recipiente de 5 litri pline cu motorină. A pus astfel în pericol siguranța călătorilor și a vehiculului încredințat. Instanța de fond a admis contestația salariatului, iar instanța superioară a admis apelul angajatorului, și rejudecând cauza pe fond, a respins contestația salariatului. [ABSTRACT FROM AUTHOR]
