    • Abstract:
The U.S. Court of Appeals for the Tenth Circuit has reversed and remanded a district court's judgment in a case involving the denial of mental health benefits. The plaintiffs, a plan participant and his dependent son, claimed that the denial of benefits was arbitrary and capricious. The defendant, the insurer that administered the plan, argued that the treatment was not medically necessary and that the substance abuse issues did not need to be addressed. The court found that the defendant wrongfully ignored the evidence of substance abuse and treatment, and remanded the case to the district court. [Extracted from the article]
