- Abstract: The purpose of this article is to propose a conceptual framework for the study of collective reparation processes in Colombia within the context of their effectiveness. Methodologically, the work is the result of a qualitative study that appropriates the tradition of Heidegger’s hermeneutic phenomenology and the technique of content analysis to contrast the current normative foundations against theoretical considerations and empirical work on reparation in the Country. This led to the recognition of the scope, limitations and suggestions for carrying out studies on this topic in the national context. In this order of ideas, the victim category is identified in its social and complex nature, which leads to the analysis of scientific works referring to reparation and that are subject to the subjective relationship of the victim with the events experienced; thus generating variability in the assessment of the experience. Faced with this, it is proposed to recognize the identity of the victim as the axis on which both the intervention and the scientific study of this type of processes run. At the same time, the studies suggest the need for a comprehensive and transformative approach to collective reparation, understanding its complexity and even the integration of non-human victims into it. However, Colombian legislation enables individualization within the cases, which impacts directly in the perception of effectiveness and in the results of the process. [ABSTRACT FROM AUTHOR]
- Abstract: El presente artículo tiene por finalidad proponer un marco conceptual para el estudio de los procesos de reparación colectiva en Colombia dentro del contexto de su efectividad. Metodológicamente, la obra es resultado de un estudio del tipo cualitativo que apropia la tradición de la fenomenología hermenéutica de Heidegger y la técnica del análisis de contenido para contrastar los fundamentos normativos vigentes frente a consideraciones teóricas y trabajos empíricos en materia de reparación en el País. Esto llevó al reconocimiento de los alcances, las limitaciones y las sugerencias para la realización de estudios sobre esta temática en el contexto nacional. En ese orden de ideas, se identifica la categoría víctima en su carácter social y complejo, lo que lleva al análisis de obras científicas referidas a la reparación y que están supeditadas a la relación subjetiva de la víctima con los hechos vividos; generando de esta manera una variabilidad en la valoración de la experiencia. Frente a ello se propone reconocer la identidad de la víctima como eje sobre el cual discurrir tanto la intervención, como el estudio científico de este tipo de procesos. Paralelamente, los estudios sugieren la necesidad de un abordaje integral y transformativo para la reparación colectiva, entendiendo su complejidad e incluso la integración a ésta de víctimas no humanas, sin embargo, la legislación colombiana posibilita la individualización al interior de los casos, lo que impacta directamente en la percepción de efectividad y en los resultados del proceso.
