Este artículo de investigación tiene un carácter descriptivo y su objetivo general es referir algunos de los retos que enfrenta el derecho constitucional y la administración pública frente a la materialización del derecho a la educación superior en México. Es así que la presente investigación insta a debatir y reflexionar sobre la naturaleza de los retos que enfrenta la administración pública para garantizar un acceso universal a la educación superior en el Estado mexicano. En atención a tal supuesto, se sostiene que el crear políticas públicas en materia de derecho a la educación superior puede coadyuvar a la administración pública para concretar este derecho en México. Para ello, el enfoque metodológico empleado es el cualitativo desde una postura epistemológica constructivista compleja. En atención a tal circunstancia, se utilizaron los métodos analítico, comparativo y descriptivo, así como técnicas de investigación indirectas, consistentes en revisión biblio-hemerográfica, dentro de la cual se destacan libros y artículos científicos. This research article is descriptive in nature and its general objective is to refer to some of the challenges that constitutional law and public administration face in the materialization of the right to higher education in Mexico. Thus, this research encourages debate and reflection on the nature of the challenges that public administration faces to guarantee universal access to higher education in the Mexican state. In response to this assumption, it is argued that creating public policies regarding the right to higher education can help the public administration to realize this right in Mexico. To achieve this, the methodological approach used is qualitative from a complex constructivist epistemological position. In response to this circumstance, analytical, comparative and descriptive methods were used, as well as indirect research techniques, consisting of biblio-hemerographic review, within which books and scientific articles stand out.
