- Abstract:
Spain was the eighth country in the world to legalize euthanasia and assisted suicide, until now only recognized in the Netherlands, Belgium, Luxembourg (2002), Switzerland; and, outside Europe, Colombia (1997), Canada (2016), some states of Australia and the United States and, recently (2022) New Zealand. The new Spanish law has some singularities, in contrast to most pro-euthanasia laws in other countries: first, the recognition of a new subjective right to request one's own death from third parties, based on human autonomy and freedom, and a rather restrictive conception of the right to conscientious objection of health professionals, materialized in the implementation of a public registry of objectors. España ha sido el octavo país del mundo en legalizar la eutanasia y la ayuda al suicidio, hasta ahora solo reconocida en Países Bajos, Bélgica, Luxemburgo (2001-2002), Suiza (donde está despenalizados hace años el suicidio asistido prestado por entidades privadas); y, ya fuera de Europa, Colombia (1997) -a la que dedicaremos una atención particular-Canadá (2016), algunos Estados de Australia y de Estados Unidos y, recientemente (2022) Nueva Zelanda. La nueva ley española tiene algunas singularidades, en contraste con la mayoría de las leyes de otros países que han legalizado esta práctica: en primer lugar, el reconocimiento de un nuevo derecho subjetivo a solicitar de terceros la propia muerte, fundado en la autonomía y la libertad humanas, y una concepción bastante restrictiva del derecho a la objeción de conciencia de los profesionales de la salud, materializada en la implementación de un registro público de objetores.
