The Higher Regional Court of Vienna has ruled that environmentally related advertising with "recycled water" is not misleading if the water is obtained through its own treatment process and no water from the tap or natural sources is used. A plastic bottle can be advertised as "100% recycled" as long as consumers can recognize the difference between the container and the closure. Advertising with a sole or leading position in recycling is allowed if the company is the first to produce its product through recycling or upcycling. It has been determined that not all materials can be recycled, and therefore the recycling rate may vary for new products. The decision of the Higher Regional Court of Vienna is seen as a turning point in case law regarding environmentally related advertising claims. [Extracted from the article]

Das OLG Wien setzte sich kürzlich mit der Frage auseinander, ob Werbeaussagen zu Recyclingeigenschaften eines Produkts gegen das Irreführungsverbot des § 2 UWG verstoßen. Dabei beurteilte es unter anderem Werbung mit „recyceltem Wasser“ als zulässig, weil es sich nicht um Werbung mit Selbstverständlichem handelte.
