    • Abstract:
      This study aims to examine and investigate Burhān al-Dīn al-Fazārī's (commonly known Ibn alFarkāh) manuscript Igaratul Iqta'a (Land Donation Rental). The study is divided into two sections. The first section was designed for the study. It introduced Ibn al-Farkāh in the first subsection. The second subsection dealt with the manuscript, discussing its attribution to the author, its importance, description of the copies, and the methodology of examining the manuscript. Samples of the two copies were also provided. The second section focused on the examined text. The study revealed that Imam Ibn al-Farkah enjoyed an esteemed status and position in the Shāfiʿī school of jurisprudence and was respectful for his scholars and jurists. It was concluded that the attribution of the manuscript to Burhān al-Dīn Ibn al-Farkāh was authentic and that many scholars were in agreement with Ibn alFarkāh and his father regarding the prohibition of land donation rental (Igaratul-Iqtaa). The present study highlighted that many of Ibn al-Farkāh's books have not been investigated yet. [ABSTRACT FROM AUTHOR]

      يهدف هذا البحث إلى دراسة وتحقيق مخطوط (إجارة الإقطاع) لبرهان الدين الفزاري الشهير بابن الفركاح، وقد انتظم في قسمين، فالقسم الأول خُصص للدراسة، وقد تحدثت فيه عن ابن الفركاح في المبحث الأول، في حين جاء المبحث الثاني للتعريف بالمخطوط، فتحدثت عن نسبة المخطوط إلى المؤلف، وأهميته، ووصف النسخ، ومنهج التحقيق، ثم أرفقت نماذج من النسختين، فيما خصص القسم الثاني للنص المحقق. وقد توصلت إلى جملة من النتائج منها: مكانة الإمام ابن الفركاح في المذهب الشافعي، وجلالة قدره، وإجلاله للعلماء والفقهاء. صحة نسبة المخطوط لبرهان الدين ابن الفركاح. أن هناك من وافق ابن الفركاح ووالدَه فيما ذهبا إليه من تحريم إجارة الإقطاع. أن ثمة كثيرا من كتب ابن الفركاح لم تحقق فيما ظهر لي بعد البحث والاطلاع.
