Selling Al-Khiraj Lands during early Islam and Ummayad period, between practical and Fiqh stance. (English)

This research deals with selling AL-Khiraj lands during early Islam and the Umayyad period, between practical jurisprudence attitude. This research is a comparative study between the jurisprudential opinions and the applied policy of the orthodox caliphs and the Umayyad ones, and the attitude towards Al-Khiraj lands. This research aims at showing the opinions of the jurists on the problem of selling Al-Khiraj lands and to know which policies followed by the caliphs were right about forbidding Al-Khiraj land or giving a permission to sell it, and which one is considered better for the public benefit that has to do with the public financial income as well as resolving the problems came as result of those policies that occurred either because of selling Al-Khiraj lands or for changing them to tithe land. All these matters have its negative reflection on the financial income because the land taxes decreased on one hand, and the taxes of the tithe became higher on the other hand, or all these may relate to the economic policy of the state and the vision about them was unclear towards the attitude towards Al-Khiraj lands. بيع البحث دراسة مقارنة بين الآراء الفقهية والسياسة التطبيقية للخلفاء الراشدين والأمويين حول الموقف من الأرض الخراجية، ويهدف البحث إلى الكشف عن آراء الفقهاء تجاه مسألة ب هل يمنعون بيعها أم يسمحون؟ وأيهما أفضل للمصلحة العامة من ناحية الإيرادات المالية العامة المشاكل التي تمخضت عن تلك السياسات كانت من جراء بيع الأرض الخراجية أم من جراء تحولها إلى أرض عشرية مما كان له الانعكاس السلبي على الإيرادات المالية لانخفاض واردات ضريبة الخراج وارتفاع واردات ضريبة العشر ، أم أنَّ ذلك راجع إلى أمور أخرى تتعلق بالسياسة الاقتصادية للدولة وعدم الأرض الخراجية؛ لمعرفة مواقف الخلفاء تجاه الأرض الخراجة ، وما ما وضوح الرؤيا حول الموقف من الأرض الخراجية.
