      On the premise of adhering to the basic principle of the supremacy of law, the integration of core values of socialism into judicial adjudication as an extrajudicial factor is of great significance for making up for the shortcomings of traditional legalism and realizing the unity of legal effect, social effect, and political effect. Due to the lack of unified guiding concepts and specific judgment norms, the courts in China are currently faced with the dilemma of simple and mechanical application, large variation in the application of “values”, rule deficiency as well as extrajudicial adjudication in the process of applying core values of socialism. To solve these problems, it is necessary to adhere to the limited application of consequentialist juridical thinking, and accordingly construct specific legal application methods and normative constraints of core values of socialism, including: clarifying the basic connotation of core values of socialism to clarify the value object of adjudicative application; distinguishing its two roles of “reasoning basis” and “adjudicative basis” in different contexts; using a variety of legal methods to strengthen the reasoning argumentation of judgement documents; and giving full play to the guiding role of adjudicative experience of guiding cases and general “similar cases”, etc. [ABSTRACT FROM AUTHOR]

      在坚持法律至上基本准则的前提下,社会主义核心价值观作为一种法外因素融入司法裁判,对于弥补传统法条主义的不足,实现法律与社会、政治效果相统一具有重要意义。由于缺乏统一的指导理念与具体的裁判规范,当前我国法院在适用社会主义核心价值观的过程中面临着适用方式简单机械、“价值”适用差异化较大以及规则逃逸、法外裁判等困境。要解决这些问题,应当坚持后果主义裁判思维有限性适用,在此基础上构建社会主义核心价值观的具体法律适用方法与规范性制约,具体包括:澄清社会主义核心价值观的基本内涵以明确裁判适用的价值对象;区分其所扮演的“说理依据”与“裁判依据”两种不同角色;综合运用多种法律方法增强裁判文书的说理论证;充分发挥指导性案例与一般“类案”的裁判经验导向作用;等等。 [ABSTRACT FROM AUTHOR]
