- Abstract: Objective: To study the institute of revisable permanent penalty in the Spanish legislation and in Brazilian bill, in order to verify if there is not a violation to human dignity and to the Brazilian Federal Constitution, concealing the law's true intention of stablishing life imprisonment. Methodology: Deductive reasoning was the utilized method. Contributions: It was demonstrated the motivations, based on the interim of the present study, that give rise to the understanding of incompatibility between the principle of human dignity and the system of the revisable permanent penalty, pointing out possible paths to guarantee what was intended without the implementation of the institute. Results: The utilization of more severe penalties does not implicate, necessarily, the decrease of criminality, on the contrary, upon the knowledge of the possibility of being imprisoned in an indefinite manner one will not think twice about continuing to commit offences, in a negative criminological reflex. On the contrary, alternatives to incarceration must be sought. Furthermore, there is a violation to the human dignity and to the national constitutional text, that forbids life imprisonment. - Abstract: Objetivo: Estudar o instituto da prisão permanente revisável na legislação espanhola e em projeto de lei brasileiro, a fim de se verificar se não ocorre a violação à dignidade humana e à Constituição Federal Brasileira, escondendo-se a verdadeira intenção da lei em se ter uma prisão perpétua. Metodologia: Utilizou-se o método dedutivo. Contribuições: Demonstrou-se as motivações, fundamentadas no ínterim do estudo, que ensejam o entendimento de incompatibilidade entre o princípio da dignidade da pessoa humana e o sistema da pena permanente revisável, apontando-se possíveis caminhos à garantia do intentado sem a implementação do instituto. Resultados: A utilização de penas mais severas não implica, necessariamente, na redução da criminalidade, pelo contrário, alguém sabedor de que poderá ficar aprisionado de forma indefinida, não pensará duas vezes em continuar a delinquir, em um reflexo criminológico negativo. Pelo contrário, se deve buscar alternativas ao encarceramento. Além disso, se tem uma violação à dignidade humana e ao texto constitucional pátrio, que veda a prisão por toda a vida.
