DIPLOMACIA E PARADIPLOMACIA DE ÁGUA: FUNDAMENTOS JURÍDICOS PARA A HIDROSSUSTENTABILIDADE. (Spanish)

WATER DIPLOMACY AND PARADIPLOMACY: LEGAL FOUNDATIONS FOR HYDROSUSTAINABILITY. (English)

Water, as a natural and essential element for life and development, is a source of conflict and also of collaboration, cooperation and life; and it challenges the Law that uses the Diplomacy and Paradiplomacy of sustainability to build new bases for water protection and governance. The present essay seeks to point out a series of elements and aspects that should be considered in the context of what is intended as hydrosustainable Diplomacy and, as a reflex and complementary way, as hydrosustainable Paradiplomacy. For such, through the zettic, dogmatic, analytical and deductive research method, the observation, analysis and reflection of the world and international legal context of water is promoted. This article applies scientific innovation and responsible research by electing foresight and effectiveness as its north, through legal essays. A água, como elemento natural e essencial à vida e ao desenvolvimento, é fonte de conflito e, também, de cooperação e de vida. Desafia o Direito que se instrumentaliza na Diplomacia e Paradiplomacia de sustentabilidade para construir novas bases de tutela e governança hídrica. O presente ensaio busca apontar uma série de elementos e vertentes que devem ser considerados no contexto do que se pretende por Diplomacia hidrossustentável e, por via reflexa, complementar por Paradiplomacia hidrossustentável. Para tanto, utilizando o método de investigação zetético, dogmático, analítico e dedutivo, promove a observação, análise e reflexão do contexto jurídico mundial e internacional da água. Esta artigo aplica a inovação científica e a pesquisa responsável ao eleger a prospectiva e a efetividade como o seu norte, por meio de ensaios jurídicos.
