- Abstract:
This study came to examine illusion and its impact on legal rulings in terms of consideration and non-consideration. As the problem of this study revolves around when delusion is considered in jurisprudence and when it is not, and its relationship to the rule of “certainty is not removed by doubt”, with an explanation of the legal and jurisprudential rooting of delusion and its applications. An exception is made from this if it is guarded against an established right or what is based on evidence; It is taken into account at that time. [ABSTRACT FROM AUTHOR]

جاءت هذه الدراسة لتبحث في التوهم وأثره في الأحكام الشرعية من حيث اعتباره وعدم اعتباره، وقد اتجهت هذه الدراسة إلى استقراء الأدلة الشرعية والاتجاهات الفقهية من خلال ذكر بعض الصور في ذلك على سبيل الذكر لا الحصر. حيث إن مشكلة هذه الدراسة تدور حول متى يكون التوهم معتبراً في الفقه ومتـى لا يكـون وعلاقتـه بقاعدة "اليقين لا يزول بالشك"، مع بيـان التأصـيل الشـرعي والفقهـي للتـوهم وتطبيقاتـه، وتوصـلت هـذه الدراسة إلـى نتـائج مـن أبر زهـا أن التـوهم الأصـل فيـه أنّـه ملغـي العمـل بـه؛ واسـتثني مـن ذلـك مـا إذا كـان يحتاط به إلى حق ثابت أو ما استند إلى دليل؛ فإنّه يراعى العمل به حينئذٍ.
