La transizione ecologica nel regolamento UE n. 241 del 2021: i futuri scenari del Next Generation EU.

      This contribution aims to provide the recent strategy used by the European Union (EU) against the serious consequences of the Covid-19 pandemic: the well-known Next Generation European Union (NGEU), with specific reference to the environmental objectives that it sets. In particular, analysed the main instrument for implementing this plan, namely regulation no. 241/2021 establishing the Recovery and Resilience Facility, and assessed the purpose of the ecological transition predetermined in the same, this work focuses on how the Member States (and, accurately, Italy) have implemented the European act, making their PNRR an instrument able to orient the entire institutional system towards the so-called “green transition”. In conclusion, the study addresses the question of the legal nature of the strategy under consideration, in order to question the future scenarios of the same and, consequently, of the environmental transformation in Europe.       Il presente contributo si propone di presentare la recente strategia di cui l’Unione europea (UE) si è avvalsa per contrastare le gravi conseguenze della pandemia da Covid-19: il noto Next Generation European Union (NGEU), con specifico riferimento agli obiettivi ambientali che lo stesso si prefigge. In particolare, analizzato il principale strumento di attuazione di tale piano, e cioè il regolamento n. 241 del 2021 che istituisce il dispositivo per la ripresa e la resilienza, e valutato lo scopo della transizione ecologica predeterminato nello stesso, questo lavoro si concentra su come gli Stati membri (e, segnatamente, l’Italia) abbiano attuato l’atto europeo, facendo del proprio PNRR uno strumento in grado di orientare l’intero sistema istituzionale verso la c.d. ‘green transition’. In conclusione lo studio affronta la questione della natura giuridica del programma in esame, al fine di interrogarsi sui futuri scenari del medesimo e, di conseguenza, della trasformazione ambientale in Europa.
