      This paper is to study environmental license and the nature of the administrative act involved. It is, in fact, an authorization, with its own characteristics that do not grant to the licensing process broad guarantees. Due to the provisions of article 225 of the Federal Constitution, the environment is an special asset that must ensure everyone has an adequate place for the maintenance. Thus, entrepreneurial activities must submit to the process of licensing that could foresee their externalities, establishing an adequate solution in the face of non-mitigation of them. The method used is the hypotheticaldeductive method and the documentary and bibliographic methodology. [ABSTRACT FROM AUTHOR]

      O artigo se dedica ao estudo da licença ambiental e da natureza do ato administrativo envolvido. Trata-se, em verdade, de uma autorização, com características próprias que não outorgam ao processo de licenciamento amplas garantias. Diante do que prevê o art. 225 da Constituição Federal, o meio ambiente é bem ambiental que deve assegurar a todos um local adequado para manutenção de todas as espécies. Desta forma, as atividades empreendedoras devem submeter-se ao processo para que suas externalidades sejam equacionadas em face da possível ou não mitigação.
