- Abstract:
This study examines an important aspect of the Islamic political system, that is, the effect of the devotional dimension in ensuring rights and performing duties. With the aim of demonstrating the effect of the devotional dimension on preserving people's rights and liberties, the study sought to answer the following questions: What is the devotional dimension in Islamic jurisprudence (Fiqh)? What is the effect of the devotional dimension in controlling the governing political authority? What is the role of the devotional dimension towards encouraging individuals to defend their rights? The study has concluded that the dominance of the devotional dimension over Islamic Legislation is a mean and guarantee for the preservation of people’s rights and liberties, and that it is an essential supporter of other guarantees. بحثت هذه الد ا رسة في جانب مهم من النظام السياسي الإسلامي، ألا وهو أثر البعد التعبدي في ضمان الحقوق وأداء الواجبات، وقد هدفت الد ا رسة إلى بيان أثر البعد التعبدي، وهل هو وسيلة للحفاظ على حقوق الناس وحرياتهم؟ ولتحقيق هذا الهدف أجابت الد ا رسة عن الأسئلة التالية: ما المقصود بالبعد التعبدي في الفقه الإسلامي؟ وما أثر البعد التعبدي في ضبط السلطة السياسية الحاكمة؟ وما أثر البعد التعبدي في دفع الأف ا رد للدفاع عن حقوقهم؟ وقد توصلت إلى أن هيمنة البعد التعبدي على التشريع الإسلامي هو وسيلة وضمان للحفاظ على حقوق الرعية وحرياتهم، وأنه يشكل ا رفدا للضمانات الأخرى.
