LEGAL INSTRUMENTS TO STIMULATE RESEARCH, DEVELOPMENT AND INNOVATION IN THE DEFENCE SECTOR FROM THE PERSPECTIVE OF FINANCIAL AND TAX LAW. (English)

In the current context of constant global change and growing global economy characterized by the acceleration of technological advances, scientific and technological research and innovation are essential for progress, economic growth and States competitiveness. For this reason, science and technology policies have become a priority to be developed in public administration's agendas. Europe recognizes that research and innovation require a predictable and favorable regulatory environment to attract private investment in order to help transfer new ideas to the market. Equally important is that public policies in these areas take into account sectoral specificities like PYME's needs or the role of public research organizations, and, at the same time, contribute to the policy objectives of the European Union and the Member States, in areas such as the environment, health, transport and, of course, security. The strategic utility of I+D+i in the security field comes not only from its contribution to the mitigation of risks and uncertainties in national defence, or from the development of military capabilities that lead to the improvement of the Armed Forces as an intelligent client, it also comes from the contribution to support and promote the incorporation of innovation in the technological base and in the domestic industry, in order to turn it into a strong industry capable of addressing new challenges. In this paper we will analyze the importance of investment in research, development and innovation in the defence sector, detailing the incentive policies that both, the European Union and Spain, have undertaken from Financial and Tax Law in order to promote the exchange of knowledge between the Armed Forces, the I+D+i community and the industry. En el contexto actual en que vivimos, marcado por cambios globales y por una economía mundial creciente caracterizada por la aceleración de los avances tecnológicos, la investigación y la innovación científica y tecnológica resultan esenciales para el progreso, el crecimiento económico y la competitividad de los Estados. Es por este motivo que la política científica y tecnológica se ha convertido en uno de los ejes prioritarios a desarrollar en las agendas de las Administraciones públicas de manos de los arts. 44.2 CE, 3.3 TUE y 179.1 TFUE. Desde Europa se reconoce que la investigación y la innovación requieren un entorno normativo previsible y favorable para atraer inversión privada y ayudar a transferir nuevas ideas al mercado. Igualmente importante es que las políticas en estos ámbitos tengan en cuenta las especificidades sectoriales, las necesidades de las pymes, la función de las organizaciones de investigación pública, y que contribuyan al mismo tiempo a los objetivos políticos de la Unión Europea y de los Estados de forma transversal, en ámbitos tales como el medioambiente, la salud, el transporte y, por supuesto, la seguridad. La utilidad estratégica del I+D+i en materia de seguridad deriva no solo de su contribución a la mitigación de riesgos e incertidumbres en la defensa nacional, o del desarrollo de capacidades militares que llevan a la mejora de las Fuerzas Armadas como cliente inteligente, sino que también contribuye al apoyo y fomento de la incorporación de la innovación en la base tecnológica y en la industria nacional, a fin de convertirla en una industria sólida y capaz de abordar nuevos retos. En este trabajo analizaremos la importancia de la inversión en investigación, desarrollo e innovación en el sector defensa, detallando las políticas de apoyo e incentivo que desde el Derecho Financiero y Tributario han emprendido la UE y el Estado español para favorecer el intercambio de conocimientos entre las Fuerzas Armadas, la comunidad de I+D+i y la industria.
