The impact of amnesty on the exploitation of influence influence. (English)

Usually, the employee who exploits his, her influence is sentenced to a criminal judgment, because the exploitation of his, her influence is considered a crime that is harmful to the public interest. A disciplinary penalty as a consequential punishment imposed on the employee exploiting his, her employment .. However, some laws exclude from the scope of the amnesty provisions applicable to subordinate punishment, as well as crimes against honor and impartiality, the employee exploiting his employment influence can not return to his job, because the amnesty is limited to the original punishment without subsidiary punishment unless the amnesty law stipulates otherwise .. Other laws provide for amnesty provisions to apply to the original and consequential and complementary penalties, so that the employee exploiting his or her functional influence covered by the Amnesty Law can return to his or her position. عادةٍ ما ٌصدر بحق الموظؾ المستؽل لنفوذه الوظٌفً حكم جزائً كون استؽبلل النفوذ الوظٌفً ٌعد من قبٌل الجرائم المضرة بالمصلحة العامة ، لكن فً هذا الصدد قد ٌطرأ على الحكم الجزائً عوارض تإدي إلى إٌقاؾ تنفٌذه ، ومن ضمنها العفو بشقٌه العام والخاص ، ومن المعلوم ٌستتبع الجزاء الجنائً جزاء تؤدٌبً كعقوبة تبعٌة تفرض على الموظؾ المستؽل لنفوذه الوظٌفً . لكن هنالك بعض القوانٌن تستبعد من نطاق سرٌان أحكام العفو على العقوبة التبعٌة ، وأٌضاً الجرائم المخلة بالشرؾ والنزاهة ، فبل ٌستطٌع الموظؾ المستؽل لنفوذه الوظٌفً العودة إلى وظٌفته وأن العفو ٌقتصر أثره على العقوبة األصلٌة دون العقوبة التبعٌة مالم ٌنص قانون العفو على خبلؾ ذلك . وهنالك قوانٌن أخرى تنص على سرٌان قانون أحكام قانون العفو على العقوبة األصلٌة وما ٌلحق بها من عقوبات تبعٌة وتكمٌلٌة ، وبذلك ٌستطٌع الموظؾ المستؽل لنفوذه الوظٌفً الذي ٌشمله قانون العفو العودة إلى الوظٌفة .
