    • Abstract:
      This research is entitled (Jurisprudence (Fiqh) of Arbitration in Hanbali School). The researcher addressed the Judicial arbitration in the School of Imam Ahmed Ibn Hanbal (MARS). It aimed to identify the fact of arbitration in Hanbali School as well as its related juristic rulings. The researcher explained the importance of arbitration and its effect on settling disputes and reducing the burden on the formal judiciary, as well as he cited evidences on its legitimacy. Furthermore, the researcher clarified the fact of arbitration lexically and contextually, as well as the difference between Judicial and arbitration and mentioned the dispute of Hanbali School concerning cases in which arbitration is permissible, its terms and conditions to be met by the arbitrator, and the effects of arbitration. The researcher used the Inductive descriptive approach. The research concluded with the most important results and recommendations. [ABSTRACT FROM AUTHOR]

      هذا بحث عنوانه: (فقه التحكيم في المذهب الحنبلي)، تناول فيه الباحث فقه التحكيم القضائي في مذهب الإمام أحمد بن حنبل رحمه الله، ويهدف هذا البحث لبيان حقيقة التحكيم، والأحكام الفقهية المتعلقة به. وقد بين الباحث أهمية التحكيم، وأثره في فصل الخصومات، وتخفيف العبء على القضاء الرسمي، وأورد الأدلة على مشروعيته، كما بين فيه حقيقة التحكيم لغة واصطلاحاً، اولفرق بين القضاء والتحكيم، وذكر خلاف الحنابلة فيما يجوز فيه التحكيم، وشروطه، وشروط المحكَّم، والآثار المترتبة على التحكيم، وقد سار الباحث على المنهج الوصفي الاستقرائي، وختم بحثه بأهم النتائج والتوصيات.
