Truth through the Microscope: Conceptualizations of Personhood and Technology in Judicial Texts on Polygraph Examinations. (English)

The German Federal Court of Justice has been skeptical of lie detection procedures and there is also an ongoing scientific debate about their reliability and validity. Despite these concerns, there is a growing demand for and discussion about this technology. Based on an analysis of publicly available court decisions and legal literature, this contribution shows two shifts in the use of lie detection. First, we highlight a fundamental change in the way personhood is conceptualized in polygraph examinations. Second, we discern a shift in the way scientific credibility is attributed to the test. Applying a science-and-technology-studies approach, we analyze how technology, subjectivity, and knowledge in the context of polygraph examinations are interrelated and conceptualized in German court rulings. Lügendetektion erlebt an deutschen Gerichten eine Konjunktur, obwohl diese Praxis wissenschaftlich umstritten ist und in der höchstrichterlichen Rechtsprechung kritisch gesehen wird. Wir analysieren die deutsche Rechtsprechung und das juristische Schrifttum zwischen 1954 und 2017 und arbeiten darin eine doppelte Verschiebung heraus, die die fortwährende Aushandlung um die Legitimität der Testverfahren erklärt. Erstens verändert sich das Verständnis des Subjekts, welches Gegenstand des Testverfahrens ist. Zweitens wandelt sich die Bewertung der Wissenschaftlichkeit und die Rolle des Apparats sowie des Testverfahrens. Aus wissens- und techniksoziologischer Perspektive zeigen wir, wie das Verhältnis von Technik und Subjekt sowie Körper und Wissen in der Rechtsprechung zur Polygraphie konzeptualisiert wird. Damit leistet der Beitrag Einsichten über die Rolle wissenschaftlicher Expertise im Rechtssystem. [ABSTRACT FROM AUTHOR]
