تعارض الرفع والوقف عند الإمام النووي دراسة تطبيقية على كتابه المنهاج في شرح صحيح مسلم بن الحجاج (Arabic)

The Conflict between the Elevated and Stopped Hadiths at the Imam Al-Nawawi’s Book Al- Minhaj In Sharh Sahih Muslim bin Hajjaj An Applied Study. (English)

This study examines the reasons of the conflict between Al-Hadith Al-Marfu (elevated: A narration from the Prophet) and Al-Hadith Al- Mauquf (stopped: A narration from a companion only) at the Imam Al-Nawawi’s Book Al-Minhaj In Sharh Sahih Muslim bin Hajjaj. The study starts with the biography of the imam, and then the definition of the contradiction between the Elevated and the Stopped, and its ruling according to the scholars. The study suggested that the weighting between the Elevation and Stopping shall be made according to evidences and weighing factors. The study application included five of the ten Hadiths of the Imam Al-Nawawi, documenting the Elevated narration over the Stopped one as an increase of confidence. Some of these were supported by evidences, some of which were not supported, and only documented as an increase of confidence. Through the applied study, it became evident for the researchers that the documentation of Al-Nawawi for the Elevated narrations and its advancement over the Stopped is not only as they increase confidence, but because of evidences supporting that documentation and advancement even if they were not written by the Imam. الملخص: يتناو ل هذ ا البحث عل ة تعارض الرفع والوق ف عن د الإمام النوو ي من خلا ل كتابه المنهاج ف شر ح صحيح مسلم ب ن الحجا ج, وقد ابتدأناه بترجمة للإمام النووي, ثم تعري ف بتعارض الرف ع والوق ف, وحكمه عند العلماء, ورجحن ا أ ن الترجيح بين الرفع والوقف, إنما يكو ن وفقاً للقرائن والمرجِّحات, ث م قمنا بدراسة تطبيقية, واشتملت هذه الدراسة على خمسة أحاديث من أصل عشرة حَكَم الإما م النوو ي بتوثيق الرواي ة المرفوعة على الموقوفة ؛ باعتبار أنها زيادة ثقة, منها م ا أيَّده بقرائن, ومنه ا ما لم يؤيده, واكتفى بتوثيقه ا باعتبا ر أنه ا زيادة ثقة, ومن خلال الدراسة التطبيقية تبي ن للباحِثَيْن؛ أن توثيق النووي للروايات المرفوع ة, وتقديمها على الموقوف ة ليس فقط باعتبار أنه ا زيادة الثقة, وإنم ا هناك قرائن ومرجحا ت تُدَعِّم ذلك التوثيق والتقدي م, وإن سكت الإمام عن ذكرها.
