The literal rule of statutory interpretation in Criminal Law. (English)
    • Abstract:
In the present article, the author analyses the literal rule of statutory interpretation in criminal law. First of all, the author underlines the importance of foreseeability for the efficient application of the literal rule. To that end, the concept of foreseeability is clarified with reference to the European Court of Human Right's case law. In the second part of the article, several canons linked to the literal rule are presented by the author, while emphasising that the rule in question is critical in the context of criminal law from the standpoint of the principle of legality. Hence, exceptions to the literal rule must be strictly construed in the field of criminal law. [ABSTRACT FROM AUTHOR]
