      The absence of a response from the MiFID to the evolution of the capital markets, in the context of the financial crisis and continuous advances in technology, has prevented the fulfilment of its objectives related with the appropriate disclosure of information to investors and the balanced control of the conduct of financial intermediaries. This has resulted in the need for an update, which has been approved 10 years later through MiFID II. Portugal is among the few EU member states whose regulators have submitted the draft law implementing MiFID II to public consultation. The new legislation is expected to come into force in the summer of 2017. [ABSTRACT FROM AUTHOR]

      A ausência de resposta da DMIF à evolução dos mercados de capitais, num contexto de crise financeira e de permanente avanço tecnológico, impediram a concretização dos seus objetivos relacionados com uma apropriada divulgação de informação aos investidores e com o controlo equilibrado da conduta dos intermediários financeiros, tornando necessária a sua atualização, que veio a ser consagrada na DMIF II, aprovada 10 anos depois. Portugal insere-se na minoria de estados-membros da União Europeia cujos reguladores colocaram já em consultas públicas o anteprojeto de transposição da DMIF II, que deverá entrar em vigor em janeiro de 2018.
