- Abstract:
The article discusses the U.S. Supreme Court's (USSC's) ruling in the 2015 case Arizona State Legislature v. Arizona Independent Redistricting Commission which deals with the American Constitution's Elections Clause (Clause) and the defendant's potential power to draw congressional districts. The USSC's possible misreading of the Clause is examined, along with partisan gerrymandering, legal precedent, and the history of the drafting and ratification of the U.S. Constitution.
