      El interés de este Auto, el penúltimo de los dictados en la AP de Madrid, se basa, además de su contenido, en que en dicha Audiencia se producen resoluciones contradictorias en orden a la cuestión que resuelve en Auto comentado. En el año 2012 han sido cinco las resoluciones dictadas, tres a favor de la tesis del Auto a que ahora nos referimos (incluido él mismo) aunque una de ellas no se refiere a desahucio sino a reclamación de cantidades asimiladas a la renta y uno en contra. Convencen los argumentos de las resoluciones favorables a la arbitrabilidad de cuestiones arrendaticias, y a la diferenciación de conceptos tales como disponibilidad, leyes imperativas y orden público. Asimismo a la limitación de las materias imperativas en el ámbito arrendaticio. Interpretación de las leyes según la realidad social del tiempo a que se aplican. Ámbito del juicio sobre los requisitos de un título ejecutivo. [ABSTRACT FROM AUTHOR]

      The interest of this Order, the penultimate dictated in the Audiencia Provincial de Madrid (High Court of Madrid), is based, as much as its content, on the fact that this Court has made conflicting decisions on this issue. In the year 2012 five decisions were made, three sharing the thesis of the order referred to here (and also by the author) although one is not about eviction but a claim for accumulated amounts of rent, and one against. The arguments of the decisions in favour of the arbitrability of rental issues, and differentiating concepts such as availability, mandatory rules and public order, are persuasive. Likewise, limiting the scope of mandatory issues in the field of rentals. Interpretation of laws in accordance with the social reality of the times to which they apply.
