- Abstract:
The Brazilian oil sector during the 90s, underwent a significant change in function of relaxing the state monopoly, allowing the entry of private and state companies for the development of the entire production process oil. So, there was a need to regulate this sector, with the purpose of designing an efficient and competitive. Therefore, this study was to investigate and analyze the process of regulating the oil industry in the Brazilian context, from 1997 to 2008, through its regulatory agency, the National Agency of Petroleum, Natural Gas and Biofuels (ANP). As methodological procedure addressed the economic regulation in Brazil and the role of the regulatory agency of the oil sector, using data from this regulatory agency. Observed in the initial production of oil, exploration and oil production, the ANP regulates the entry of firms in this sector through a bidding process. The phase of transport and refining presented being less competitive, with the supervision of the ANP. In the final step distribution and resale there was highly competitive, with this regulatory agency monitoring the quality of petroleum products and prices in the market. [ABSTRACT FROM AUTHOR]

O setor petrolífero brasileiro, durante os anos 90, passou por uma significativa mudança em função da flexibilização do monopólio estatal, o que permitiu a entrada de empresas privadas e estatais para o desenvolvimento de todo processo produtivo petrolífero. Diante disso, houve a necessidade de regular esse setor, com o propósito de estruturar um sistema eficiente e competitivo. Assim sendo, o presente estudo procura investigar e analisar o processo de regulação do setor petrolífero no contexto brasileiro, no período de 1997 a 2008, por meio de sua agência reguladora, a Agência Nacional do Petróleo, Gás Natural e Biodiesel (ANP). Como procedimento metodológico abordou-se a regulação econômica no Brasil e o papel da agência reguladora do setor petrolífero, empregando dados da ANP. Observou-se na fase inicial da cadeia produtiva do petróleo, a exploração e a produção petrolífera, que a ANP regula a entrada de empresas neste setor por meio de um processo licitatório. A fase de transporte e refino apresentou-se como menos competitiva, contando com a fiscalização da ANP. Na etapa final de distribuição e revenda verificou-se elevada competitividade, com esta agência reguladora monitorando a qualidade dos produtos derivados do petróleo e os preços praticados no mercado.
