REGIONAL AID AS AN EXAMPLE OF PERMITTED CONDITIONALLY STATE AID IN THE EUROPEAN UNION. (English)

The aim of this article is to present the conditions of admissibility of state aid in the European Union, with particular emphasis on horizontal aid for regional development. It is intended to verify the statement that - due to the fulfillment of the Lisbon Agenda and Europe 2020 strategy guidelines on state aid - the value of horizontal aid for regional development has been growing, while the principle of limited state aid has been maintained. As a result, state aid for regional development has currently the largest share of total aid for the industry and services in the European Union. This thesis has been proven. [ABSTRACT FROM AUTHOR]

Celem artykułu jest przedstawienie warunków dopuszczalności pomocy publicznej w Unii Europejskiej, ze szczególnym uwzględnieniem zasad stosowanych w przypadku pomocy horyzontalnej w zakresie rozwoju regionalnego. Badania źródłowe w tym kierunku zostały przeprowadzone w oparciu o Traktat o funkcjonowaniu Unii Europejskiej, orzecznictwo Trybunału Sprawiedliwości oraz akty prawa wtórnego. Analiza pomocy regionalnej została przeprowadzona ze względu na realizację zaleceń Strategii Lizbońskiej oraz strategii Europa 2020 odnośnie do zdecydowanego zwiększania w ogólnej strukturze pomocy publicznej wsparcia kierowanego na cele horyzontalne. W artykule przyjęto tezę, że w związku z wypełnianiem postanowień traktatowych i zaleceń Strategii Lizbońskiej oraz strategii Europa 2020 w zakresie udzielania przez państwa członkowskie pomocy publicznej, regionalna pomoc państwa jest celem horyzontalnym, który ma obecnie największy udział w całkowitej pomocy publicznej dla przemysłu i usług w UE.
