    • Abstract:
      The herein study analyses the internship contract regulated by Law No. 335/2013 on performing the training period for the higher education graduates. The enforcement of Law no. 335/2013 was necessary and expected, being imposed by Article 31 paragraphs 5 and 6 of Labor code. Article 31 paragraph 5 of Labor code provides that for the higher education graduates, the first 6 months after the professional debut are considered period of internship. The modality of performing the internship is regulated by Law no. 335/2013, except for those professions (magistrates, physicians, chemists etc.) for which the internship is regulated by means of a special law. The internship represents the compulsory period of time - usually of 6 months - expressly regulated by law, ensuring the transition of the higher education graduates from the education system to the labor market, the consolidation of the professional competences and skills for the adaptation to the practical requirements and exigencies of the working place and for a faster work integration, as well as the acquirement of work experience and seniority, or according to each case, specialty. The internship contract is concluded as an annex to the individual employment contract. Therefore, the legal regime of the internship contract follows the fate of the main act. However, the internship contract presents certain peculiarities that are enunciated in the study, and represents a concept distinct from the probation period. [ABSTRACT FROM AUTHOR]
