- Abstract:
The article discusses the concept of „mitior lex” as it pertains to human rights law and fundamental rights and liberties law, as understood and applied in the jurisprudence of the Constitutional Court of Romania. A theoretical distinction is made between the way in which the concept is used in criminal law as opposed to the way in which it is used in human rights law, and the situations in which national law was considered the more favorable law by the Constitutional Court are highlighted, particularly in what concerns property and rights assimilated to property.
